Terms And Conditions

By placing an order with Chris Sallis, you confirm that you are in agreement with and bound by the terms and conditions below.

Definitions:
The Client : The company or individual requesting the services of Chris Sallis
Chris Sallis: The partners, their employees or appointed agents.

General
Chris Sallis will carry out work only for clients who are 18 years of age or above.

Free Visual
Our free visuals are provided as a guide to how your project will look, this image is used by the client to inform us of any necessary style changes etc. No work will commence on the actual website until the visual is approved by the client.

We hold the copyright for any visual provided, the client may not use this image for any other purpose but to advise us of any changes, decline or approve the project. Any other uses is forbidden without Chris Sallis written consent.

Website Design
Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Chris Sallis cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.

The hosting account, domain name, website, graphics and any programming code remain the property of Chris Sallis until all outstanding accounts are paid in full.
Any scripts, cgi applications or software (unless specifically agreed) written by Chris Sallis remain the copyright of Chris Sallis and may only be commercially reproduced or resold with the written permission of Chris Sallis.

Chris Sallis cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Any additions to the approved visual and brief will be carried out at the discretion of Chris Sallis and we reserve the right to charge an according amount for any correction to these or further additions agreed with the client prior to making the additions.

The client agrees to make available as soon as is reasonably possible to Chris Sallis all materials required to complete the site to the agreed standard and within the set deadline. We reserve the right to cancel any project due to unavailability of materials from the client to allow us to complete the site.

Chris Sallis will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Chris Sallis will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents

Chris Sallis will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Database, Application, Feature Integration and E-Commerce Development
Chris Sallis cannot take responsibility for any losses incurred by the use of any software, scripts, applications or databases created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.

Any scripts, cgi applications or software (unless specifically agreed) written by Chris Sallis remain the copyright of Chris Sallis and may only be commercially reproduced or resold with the written permission of Chris Sallis.

Where applications or sites are developed on servers not set up by Chris Sallis, the client is expected to provide or seek any information, additional software, support or co-operation pertaining to the server required in order for the application to be correctly developed.

Where large applications are to be developed, it is the clients responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by Chris Sallis before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Chris Sallis will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.

Compatibility
Chris Sallis will endeavour to ensure that any developed/designed site or application will function correctly on the server it is initially installed.

Chris Sallis endeavours to create all projects to be compatible with as many web browsers as possible but cannot guarantee that any custom applications, databases and software will display correctly with all browsers.

Website Hosting
Whilst Chris Sallis does not host its clients websites we do have a number of close contacts in the hosting industry and can set up suitable hosting packages and register domain names on the clients behalf at no profit to ourselves.

The client is expected to pay the hosting cost and domain name fee's set forth by the hosting company.

Chris Sallis may with prior agreement with the client pay the hosting company in advance for hosting accounts and domain registrations and as such the client will be expected to repay this charge to us on the final invoice. Should the client cancel our services the client is still responsible for paying the hosting charges and domain fee's if Chris Sallis has already ordered it at the clients instruction.

Cancellation
The client may cancel their project by a written request and under normal circumstances will not be invoiced for any work developed by Chris Sallis. If the client already has a copy of the work then a fee may be charged.

If the client has instructed Chris Sallis to set up a hosting account and/or register a domain name then the client will still be responsible for paying these fee's.

Payment of Accounts
Upon completion the client will have the opportunity to test the finished project on our private server. Once testing is complete and the client approves the work then an invoice will be issued. Payments are to be made immediately upon receipt of this invoice.

Websites will not be uploaded to the clients hosting package until payment is received unless Chris Sallis set up the hosting package. It is at the sole discretion of Chris Sallis whether the website can be uploaded prior to payment being received to any other web server.

Chris Sallis reserves the right to remove or suspend any website that payment falls overdue without warning and your account may be passed to a debt collectin agency to recover our fee's and costs. Debt collection can be avoided by contacting Chris Sallis and arranging for payment to be issued, once issued the website will be reinstated.
